Group rape at a Miramar campsite: they annulled the acquittal and ordered a new trial

Lucas Pitman (24), Tomás Jaime (26) and Juan Cruz Villalba (25) They had come to trial last September accused of raping a 14-year-old teenager at the El Durazno campsite in Miramar and a popular jury found them not guilty. However, now they will return to sit in the dock after a ruling by the Court of Cassation annulled the verdict and ordered a new trial, with another jury.

This is how the judges decided Ricardo Borinsky and Víctor Horacio Violini, of Chamber III of the highest criminal court, after a presentation by the victim’s lawyers, Juan Pablo Gallego and Maximiliano Orsini.

The lawyers raised the nullity of the debate and the verdict as a result of various irregularities, such as “the absence of the Advisor for Minors and Incapacitated Persons, the absence of audiovisual record of the hearing of instructions to the jurors, the statement obtained in the person of the victim in conditions of serious helplessness and outrage that occurred during the debate and in all subsequent acts, extending the obvious invalidity to the verdict of the jury ”.

This claim of unconstitutionality was rejected first by the judge Fabián Riquert. However, the lawyers questioned that resolution and raised their claim to Cassation, understanding that the magistrate did not deal with any of the annulments that they had raised.
